Driver's License Suspension

If you are convicted of DUI, the State of Georgia will suspend your Georgia driver’s license. In some cases it is possible to obtain a limited “work” permit that will allow you to drive to and from work and school. In other cases, if you are convicted, there is no limited permit available at all. You simply cannot drive for the entire length of the suspension.
Specific Driver’s License Suspensions
First offense in 5 years – Over 21 driver who submitted to breath or blood test – 1 year suspension with “work” permit available. Early reinstatement after 120 days provided DUI school has been completed and a reinstatement fee paid.
- Over 21 driver who refused to submit to a breath or blood test – 1 year hard suspension. No “work” permit available. No driving at all and no early reinstatement.
- Under 21 driver with a blood alcohol level of greater than .08 – 1 year license suspension with no “work” permit available. No driving at all and no early reinstatement.
- Under 21 driver with a blood alcohol level of less than .08 – 6 months license suspension. No “work” permit available. No driving at all and no early reinstatement.
- Under 21 driver who refused to submit to a breath or blood test – 1 year hard suspension. No “work” permit available. No driving at all and no early reinstatement.
Second offense in 5 years – 3 year suspension. After 12 months of “hard”suspension, a driver age 21 and over can obtain a limited permit if they have an ignition interlock device; otherwise the “hard” suspension period is 18 months. Reinstatement of the driver’s license after 18 months for all driver’s may be possible if DUI school has been completed, a clinical evaluation and treatment has been completed and a reinstatement fee paid.
Third offense in 5 years – 5 year revocation. After 2 years, drivers age 21 and over may apply for a probationary license, but must have an ignition interlock device.
